Terms of Service

These Terms of Service ("Terms") form a binding agreement between you (the business account holder, merchant, or seller who creates or manages a catalog on WebCatalog) and WebCatalog ("we", "us", or "our"), operated via webcatalog.in. Please read these Terms carefully before using the Service.

1. Agreement, Acceptance, and Document Hierarchy

By creating an Account, clicking to accept these Terms (or any comparable acceptance mechanism we present), accessing the dashboard, or continuing to use the Service after notice of these Terms, you acknowledge that you have read, understood, and agree to be bound by these Terms. Electronic records, electronic acceptance, and electronic communications relating to these Terms and the Service are valid and enforceable under the Information Technology Act, 2000 and applicable rules, to the maximum extent permitted by law.

These Terms apply to business account holders who create, configure, or operate a product catalog through WebCatalog. Visitor-facing terms for buyers who browse or inquire on merchant catalogs are set out separately in our Terms of Use. Our Privacy Policy explains how we handle personal data.

Document hierarchy: If there is a conflict among documents for a given subject matter: (a) these Terms of Service control for Account holders and merchants using the Service; (b) the Privacy Policy controls for personal data processing practices described therein; and (c) the Terms of Use control for catalog visitors and inquirers who do not hold a merchant Account. If you use the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Definitions

  • Service: WebCatalog's B2B product catalog storefront, inquiry and lead tools, related web and Android app features, and associated hosting and support.
  • Account: Your registered WebCatalog business account and dashboard credentials.
  • Content: Text, images, videos, product data, pricing, pages, branding, and other materials you upload or configure in your catalog.
  • Plans: Subscription tiers described on webcatalog.in/pricing (currently Forever Free, Growth, and Business), including feature entitlements and fees.
  • Subdomain: A hostname under webcatalog.in (for example, yourbrand.webcatalog.in) provided for catalog hosting.
  • Custom Domain: A domain you control (for example, abc.com or abc.in) that you may connect to the Service on eligible paid Plans.
  • Buyer / Inquiry: A visitor who submits contact details or a message through your catalog's inquiry, chat, or WhatsApp inquiry features.

3. Eligibility and Account Security

You must be at least eighteen (18) years of age and have the legal capacity to enter into a binding contract under applicable law. You must provide accurate, complete, and current registration information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your Account. Notify us promptly at support[at]webcatalog[dot]in of any unauthorized access or suspected security breach. We may refuse registration, suspend, or terminate Accounts that violate these Terms or applicable law.

4. Description of Service

WebCatalog provides a technology platform for businesses to publish digital product catalogs and receive buyer inquiries (including inbox/chat and WhatsApp inquiry flows). The Service is a catalog and lead / inquiry facilitation tool. It is not a payment marketplace, escrow service, or payment processor for goods sold through your catalog.

Deals, negotiations, payments, delivery, warranties, and fulfillment that occur via chat, call, WhatsApp, or offline are solely between you and the Buyer. WebCatalog is not a party to those transactions and is not responsible for their outcome.

5. Plans, Fees, Billing, Auto-Renewal, and Changes

Feature access depends on your Plan. Current Plans and featured entitlements are described on /pricing and may include:

  • Forever Free (₹0 forever): Host on a webcatalog.in Subdomain (for example, abc.webcatalog.in / yourbrand.webcatalog.in); core catalog storefront; SEO-ready pages; inquiries; inbox + chat; WhatsApp inquiry; Android app access; Website Analytics; Chat Bot; unlimited products and categories; AI-Generated Standard Content with 100 Credits Free. Custom Domain is not included.
  • Growth (₹5,999 / year): Everything in Forever Free, plus Custom Domain hosting (for example, abc.com / abc.in), Quantity Ranges, Unlimited Custom Pages, Testimonials, Brand Video, and AI-Generated Standard Content with 500 Credits Free.
  • Business (₹11,999 / year): Everything in Growth, plus AI-Generated Standard Content with 1200 Credits Free, B2B Pricing (for resellers and wholesalers), Subscribers List, Business Email, and Monthly SEO Report.

Compare-plan details on /pricing also note features such as SSL, storefront templates, notifications, and unlimited storage/bandwidth across Plans where stated. Fees and inclusions are as displayed on /pricing unless we state otherwise at purchase. Applicable taxes may apply as shown at checkout or on the pricing page (including where pricing is presented as tax-inclusive). Custom Domain is available on Growth and Business Plans (Growth and above).

Paid Plan fees apply when you subscribe to a paid Plan (Growth or Business). Subscriptions for paid Plans are billed annually unless we offer another billing period at purchase. Payment checkout may be completed through our designated flows or support processes; starting at /get-started does not itself waive fees for paid features.

Auto-renewal: Where billing is enabled, paid Plans may automatically renew for successive annual terms (or other billing periods stated at purchase) unless you cancel before the renewal date through the method we provide. By subscribing where recurring billing is configured, you authorize WebCatalog and our payment processor to charge the applicable fees (including taxes) on a recurring basis to your designated payment method until you cancel in accordance with these Terms or the cancellation instructions provided at purchase or in the Service.

We may change Plan prices, features, or packaging. For renewals of paid Plans, we will provide reasonable notice of material price changes before they take effect on renewal. Continued use after the effective date of a change constitutes acceptance, subject to any cancellation rights we state at purchase or that are required by law.

If a paid Plan is unpaid, expires, or is otherwise not renewed, we may remove or disable paid-only features (including Custom Domain connectivity), move the Account to Forever Free where feasible, and/or suspend Custom Domain-related hosting until the subscription is restored. Subdomains under webcatalog.in remain WebCatalog property. You remain responsible for Custom Domain DNS configuration, registrar renewal, and any third-party domain costs.

Fees are non-refundable except where required by applicable law or where we expressly state a refund policy at the time of purchase. We do not claim that all features are free, that no payment will ever apply, or that there are no fees for paid Plans.

6. User Content and License

You retain ownership of your Content. You grant WebCatalog a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and transmit your Content solely as needed to operate, secure, and improve the Service and to display your catalog to visitors. You represent that you have all rights necessary to upload the Content and that it does not infringe third-party rights or violate law.

7. Platform Intellectual Property

Except for your Content, WebCatalog and its licensors own all right, title, and interest in and to the Service, including software, code, templates, user interface designs, documentation, logos, trademarks, trade dress, and other WebCatalog branding. No rights are granted to you except as expressly set out in these Terms. You may not: (a) copy, modify, distribute, sell, or sublicense the Service or any part of it; (b) reverse engineer, decompile, disassemble, or attempt to derive source code from the Service except to the limited extent such restriction is prohibited by law; (c) scrape, crawl, or harvest data from the Service at scale or through automated means in a manner that overloads, interferes with, or circumvents access controls; or (d) remove or obscure proprietary notices.

8. Feedback

If you provide ideas, suggestions, or feedback about the Service ("Feedback"), you grant WebCatalog an irrevocable, perpetual, worldwide, royalty-free, fully paid-up license to use, reproduce, modify, distribute, and otherwise exploit such Feedback for any purpose, without obligation, attribution, or compensation to you. Feedback is not confidential unless we agree otherwise in writing.

9. Prohibited Conduct

You may not use the Service to:

  • Post illegal, fraudulent, deceptive, defamatory, or harmful Content.
  • Infringe intellectual property, privacy, or other rights of others.
  • Distribute malware, viruses, or other harmful code.
  • Impersonate another person, brand, or business.
  • Spam, harass, or abuse Buyers, other users, or our systems (including scraping or automated abuse).
  • Attempt unauthorized access to the Service, Accounts, or related systems.
  • Use the Service in any way that violates applicable law or these Terms.

10. Fair Use, Free Plan Abuse, Domains, and Branding

webcatalog.in Subdomains are provided for your use while your Account remains in good standing and are not sold to you. We may throttle, suspend, disable, rename, reclaim, or otherwise limit Accounts, catalogs, or Subdomains for abuse, inactivity, trademark or brand abuse, phishing or impersonation risk, excessive automated use, Free Plan abuse, or breach of these Terms. Custom Domains are available on Growth and Business Plans as described on /pricing. You are responsible for domain ownership, DNS, SSL setup where applicable on your side, and renewals with your registrar.

11. Beta and Experimental Features

We may offer beta, preview, or experimental features. Such features are provided "AS IS" without warranties of any kind, may be unstable or incomplete, and may be modified or withdrawn at any time without liability. Your use of beta features is at your sole risk.

12. Third-Party Services, Android App, and WhatsApp

The Service may integrate or link to third-party services (including hosting, messaging, analytics, app stores, WhatsApp, and payment or billing providers when you subscribe to a paid Plan). Your use of those services is subject to their own terms and privacy policies. The Android app may request permissions (such as camera or gallery) only upon your explicit action to capture or upload Content.

13. Monitoring and Enforcement

We may, but are not obligated to, monitor use of the Service, investigate suspected violations, remove or disable Content or catalogs, suspend Accounts, and report unlawful activity to law enforcement or regulators. Our failure to enforce any provision is not a waiver of our right to do so later.

14. Export, Sanctions, and Lawful Use

You may use the Service only for lawful purposes and in compliance with applicable laws, including export control, sanctions, and trade restrictions. You represent that you are not located in, organized under the laws of, or ordinarily resident in a jurisdiction subject to comprehensive sanctions that would prohibit use of the Service, and that you are not a denied or restricted party under applicable sanctions lists. You will not use the Service to export or re-export restricted items or data in violation of law.

15. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. We do not warrant uninterrupted or error-free operation, or that Content or inquiries will meet your commercial expectations.

16. Limitation of Liability

To the maximum extent permitted by law, WebCatalog and its affiliates, officers, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption, arising from or related to the Service or these Terms, whether based on contract, tort, or any other theory.

Our aggregate liability for all claims relating to the Service in any twelve (12) month period is limited to: (a) for paid Accounts, the total fees you actually paid to WebCatalog for the applicable Plan in the twelve (12) months immediately preceding the claim; or (b) for Forever Free Accounts, ₹1,000 (one thousand Indian Rupees). These limits apply even if a remedy fails of its essential purpose, except where liability cannot be limited under applicable law.

17. Indemnity

You agree to indemnify, defend, and hold harmless WebCatalog and its affiliates from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your Content; (b) your use of the Service; (c) your dealings with Buyers, including offline, WhatsApp, call, or chat transactions; (d) your violation of these Terms or law; or (e) your infringement of third-party rights.

18. Remedies

You acknowledge that a breach of provisions relating to intellectual property, confidentiality, Account security, or unauthorized use of the Service may cause irreparable harm for which monetary damages may be an inadequate remedy. Accordingly, WebCatalog shall be entitled to seek injunctive or other equitable relief to prevent or stop such breach, without the necessity of posting a bond or other security to the extent permitted by applicable law, in addition to any other remedies available at law or in equity.

19. Suspension and Termination

You may stop using the Service and request Account closure subject to our data retention practices. We may suspend or terminate access immediately if you breach these Terms, create legal or security risk, fail to pay for a paid Plan, or if we discontinue the Service.

Effects of termination: Upon termination or closure, licenses we granted to you end. We may delete or disable your Content, catalogs, Subdomains, and Account data after a reasonable notice or wind-down period. It is your sole responsibility to export any Content or data you wish to retain before closure. To the maximum extent permitted by law, WebCatalog has no liability for deletion of Content or data after such period. Accrued fees remain payable. Surviving provisions continue as stated in Section 24.

20. Notices

Notices under these Terms may be given by email. Notices to you are deemed given when sent to the email address associated with your Account. Notices to WebCatalog are deemed given when sent to support[at]webcatalog[dot]in. We may also provide notices through the Service dashboard or by posting on webcatalog.in where appropriate.

21. Force Majeure

WebCatalog shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, shortages of transportation, facilities, fuel, energy, labor, or materials, failures of utilities or telecommunications, cyberattacks, or failures of third-party hosting or network providers.

22. Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms, in whole or in part, to an affiliate or to a successor in connection with a merger, acquisition, corporate reorganization, or sale of assets or of the Service, without your consent. These Terms bind and benefit permitted successors and assigns.

23. General Provisions

  • Severability: If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
  • Waiver: No waiver of any term is effective unless in writing and signed by the waiving party. A waiver of one breach is not a waiver of any subsequent breach.
  • Entire agreement: These Terms, together with the Privacy Policy and any order, plan, or checkout terms expressly incorporating these Terms, constitute the entire agreement between you and WebCatalog regarding the Service and supersede prior or contemporaneous agreements on that subject.
  • No third-party beneficiaries: These Terms do not create any third-party beneficiary rights except as expressly stated.
  • Relationship of parties: The parties are independent contractors. Nothing in these Terms creates a partnership, joint venture, agency, fiduciary, or employment relationship between you and WebCatalog.

24. Survival

The following survive termination or expiration of these Terms: accrued fees and payment obligations; Sections concerning User Content licenses to the extent needed for wind-down and backups; Platform Intellectual Property; Feedback; Disclaimers; Limitation of Liability; Indemnity; Remedies; Notices; Force Majeure; Assignment; General Provisions; Survival; Governing Law and Jurisdiction; and any other provisions that by their nature should survive.

25. Changes to Terms

We may update these Terms from time to time by posting a revised version on this page and updating the "Last Updated" date. Material changes may also be communicated through the Service or by email where appropriate. Continued use after the effective date constitutes acceptance of the updated Terms.

26. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Subject to any mandatory consumer protections that cannot be waived, courts in Noida, Uttar Pradesh, India shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service.
